Terms of Service
«Ad Fontes» welcomes you!
This Agreement governs the terms by which clients of «Ad Fontes» obtain the right to use all provided web hosting services. «Ad Fontes» provides its Service to you subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you.
General terms
WHEREAS, «Ad Fontes» is a provider offering storage and high-quality web hosting services over the Internet through access to web servers situated in USA;
WHEREAS, such services provide high-speed connection to the main supporting points of Internet providers worldwide;
WHEREAS, Customer seeks to utilize «Ad Fontes»' services for its own purposes;
NOW THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows:
These Terms of Service have a virtue of Agreement between the Provider of web hosting services «Ad Fontes» and the natural or artificial person who uses the Service, namely the Customer.
The Customer understands and agrees to adhere to the Terms of Service while he or she uses web hosting services offered by «Ad Fontes».
Customer rights
The Customer is permitted to use the Service adhering to this Agreement terms.
The Customer is permitted to request information from the Provider on current rates of used disk space and bandwidth in order to monitor and control his/ her consumption and to prevent any possible Service interruption by reasons of exceeded bandwidth or storage limit.
In case of losing any web content Customer may ask the Provider an archive of content from the last 24 hours or restoration of the status of his/her database within 5 days ago.
The Customer is permitted to request information from the Provider in case of temporary service interruptions or failure as well as to request a refund of part of the fee in case of proven lack of Service for over 20% of prepaid hosting fee.
Customer duties
The Customer agrees to adhere to this "TOS" while he or she uses the Service.
The Customer agrees to prepay fee for hosting services offered by the Provider. The Provider may terminate or suspend customer access to the Service if the fee for the next period of use is not paid.
The Customer undertakes not to publish content that violates the laws of the Republic of Bulgaria and the laws of the United States.
Content infringing these "TOS" includes, but is not limited to: pornographic materials, materials which pander intolerance; materials which infringe copyright or intellectual property rights; materials whose rights are not owned by the Customer, viruses, scripts and code, which can cause loss of server information, or to take advantage of any punctures in the servers security; cracks and serial numbers generators.
The Customer agrees to provide all necessary information on Provider demand in order to ensure quality Service maintenance.
Provider rights
The Provider may terminate Service under this Agreement at any time, without penalty, if the Customer fails to comply with the "TOS" including non-payment.
The Provider reserves the right to terminate Service and/or delete the storage content of a Customer 20 working days after completion of the prepaid period.
Provider duties
The Provider of web hosting services is obliged to provide quality and uninterrupted Service; to hear and meet in written or electronic form all the Customer's questions associated with quality of the Service in a period of 3 business days.
The Provider of web hosting services is obliged to terminate access to the Service on the expiry of the prepaid period. The content of Customer will be stored no longer than 20 working days after the expiry of the prepaid period. It will be restored only after the Customer prepays Service for a new period.
The Provider of web hosting services is obliged to terminate Service until the start of a new calendar month in case of exceeding the prepaid monthly traffic. At a request of advance restoration of the Service, Provider is obliged to charge the Customer as the price list for using the Service.
The Provider of web hosting services is obliged to request all necessary information from the Customer to ensure quality maintenance of Customer accounts.
